1.1 These website terms of use (“Terms”) apply to your use of the website at https://www.peachyproductions.com (“the Website”), operated by Peachy Productions (London) Ltd, trading as Peachy Productions (“Peachy Productions”, “the Company”, “we”, “us” or “our”).

1.2 By browsing or otherwise using the Website, you agree to these Terms. If you do not agree to them, please stop using the Website.

1.3 These Terms govern use of the Website only. They are not the contract for any equipment hire or event production services you book with us. Equipment hired without crew is governed by our Terms & Conditions of Dry Hire; hire that includes crew or other personnel, or other event production services, is governed by our Terms & Conditions of Crewed Hire or a bespoke written agreement, as applicable. Browsing the Website or submitting an enquiry does not, by itself, create a contract for services — see clause 5.3.

1.4 Our Privacy Policy and Cookie Policy (available on the Website) explain how we use personal data and cookies, and are incorporated into these Terms by reference.

1.5 Nothing in these Terms affects your statutory rights as a consumer (an individual acting for purposes wholly or mainly outside their trade, business, craft or profession), including under the Consumer Rights Act 2015. Where any provision of these Terms conflicts with those statutory rights, the statutory rights prevail.

4.2 You may view, download and print pages from the Website for your own personal, non-commercial use, provided you do not modify any content and you keep all copyright and other proprietary notices intact. Any other use of the Website’s content requires our prior written consent.

5. Enquiries, Bookings and Content You Submit

5.1 If you submit an enquiry, booking request, newsletter sign-up or other content through the Website, you confirm that the information you provide is accurate and that you have the right to submit it.

5.2 You must not submit any content that is unlawful, defamatory, obscene, threatening, infringes a third party’s rights, or contains viruses or other harmful code.

5.3 Submitting an enquiry or booking request through the Website does not, by itself, create a contract between you and the Company. A contract for equipment hire or services only arises once we have confirmed a booking in writing (for example, by signed quotation, invoice or written confirmation), on the applicable terms and conditions referred to in clause 1.3.

6.1 The Website may contain links to third-party websites. We do not control, and are not responsible for, the content, accuracy or availability of those websites, and including a link does not imply that we endorse them.

7. Availability and Accuracy

7.1 We aim to keep the Website available and its content accurate and up to date, but we do not guarantee this. We may suspend, withdraw or restrict access to all or part of the Website at any time and without notice, for example for maintenance or updates.

7.2 Content on the Website, including descriptions of our services, pricing and availability, is provided for general information only and does not constitute a binding offer. It is not a substitute for a formal quotation.

8.3 Subject to clause 8.1, we are not liable for any loss or damage arising from your use of, or inability to use, the Website, including any indirect or consequential loss, or loss or damage arising from any virus or other harmful material obtained via a link on the Website.

11.2 A person who is not a party to these Terms has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any of them, save where that Act or another enactment expressly provides otherwise.

11.3 These Terms are governed by and construed in accordance with the laws of England and Wales, and the parties submit to the exclusive jurisdiction of the courts of England and Wales, save that this does not deprive a consumer resident elsewhere in the UK of any protection given by the law of their own residence.
